Terms and Conditions
1. Scope of Application
These General Terms and Conditions ("GTC") apply to all orders and contracts concluded via www.lilya.ch .
Lilya GmbH may adjust the GTC at any time. The version published in the online shop at the time of the order is authoritative.

3. Offer & Delivery Area
The offer is directed at natural persons with domicile and legal entities with registered office in Switzerland. Deliveries are made exclusively to addresses in Switzerland.
Illustrations and information in the shop are for illustration purposes only and are non-binding; price and assortment changes are possible at any time. "While stocks last".
4. Order & Conclusion of Contract
The presentation of products is not a legally binding offer. By placing an order, the customer makes an offer. After receiving the order, we will send an order confirmation (without contractual effect).
The contract is only concluded with our shipping/order confirmation or upon delivery of the goods.
We may reject orders in whole or in part without stating reasons; any payments already made will be refunded in this case.
5. Prices & VAT
All prices are in Swiss Francs (CHF), including statutory VAT, unless otherwise noted.
The price displayed in the online shop at the time of the order is decisive. Discount codes or vouchers cannot be applied retroactively.
6. Payment Methods
Payments are made in CHF. Available payment methods (shown at checkout):

Purchase on account via Powerpay (MF Group AG)
For purchases on account, Powerpay (MF Group AG, St. Gallen) takes over the claim and handles the billing process (incl. partial payment option, any creditworthiness check, fees for late payment).

Card data is processed exclusively by the respective payment service; we do not store full card data.
7. Delivery
Deliveries are made by the Swiss Post to the address provided by the customer.
The indicated delivery times are non-binding guidelines.
If the customer is absent during delivery and no delivery instructions are available, the Post will leave a pickup invitation. Uncollected shipments will be returned to us; we may cancel the order and refund the purchase price minus shipping/return costs (CHF 8) and a reasonable processing fee.
8. Transfer of Risk
The risk passes to the customer as soon as the shipment has been delivered and accepted by them or an authorised person. A different assumption of transport costs does not change this.
9. Shipping Costs
The shipping costs communicated in the online shop apply.
For orders over CHF 120.–, delivery is free of charge.
If the order value is subsequently reduced below CHF 120.– due to a return, CHF 8.– shipping costs will be deducted from the refund.
10. Obligation to Inspect & Defects
The customer must inspect the delivery immediately, at the latest within 5 calendar days of receipt, for correctness, completeness, and integrity.
Transport damage must be reported to the Post immediately.
Complaints to us should be sent by e-mail to info@lilya.ch, including order number, description, and photos.
For justified defects, we will provide replacement, repair, or refund/reduction, at our discretion. Further claims are excluded, unless mandatory law provides otherwise.
11. Voluntary Right of Return (14 days)
Irrespective of statutory warranty rights, we grant a right of return of 14 days from receipt of the goods.
Procedure:

The goods must be returned unworn, unwashed, undamaged, with original packaging and labels.

Excluded are personalized items, hygiene articles (if opened/unsealed), and gift cards.

After receipt and inspection, the value of the goods will be refunded via the original payment method.

Shipping costs are not refunded. For free shipping (order value from CHF 120.–), CHF 8.– shipping costs will be deducted retrospectively.

Refunds will be made within 14 days of the return's arrival.
12. Product Warranty
The statutory provisions apply (Art. 197 et seq. OR).
Damages due to normal wear and tear, improper use, lack of care, or external influence are excluded.
13. Retention of Title
The delivered goods remain the property of Lilya GmbH until full payment. We are entitled to register a retention of title in the register.
14. Liability
We are liable without limitation for intent and gross negligence.
In cases of simple negligence, we are only liable for personal injury and essential contractual obligations (cardinal duties), limited to the foreseeable, typical damage.
Product liability claims remain unaffected.
15. Data Protection
The processing of personal data is governed by our Privacy Policy (available in the footer of the online shop).
16. Applicable Law & Place of Jurisdiction
Swiss law applies, excluding conflict of laws and the UN Convention on Contracts for the International Sale of Goods (CISG).
For companies, Baden (AG) is the exclusive place of jurisdiction.
For consumers, the statutory places of jurisdiction apply (consumer's place of residence or Lilya GmbH's registered office in Baden).
17. Final Provisions
Should individual provisions be wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected (severability clause).
